Terms of Use

These terms apply to the Make it Train app and the makeittrain.app website, published by Make it Train (“we”, “us”). By downloading or playing the game you agree to them. If you don’t agree, please don’t use the app.

1. Your licence to play

We give you a personal, non-exclusive, non-transferable, revocable licence to download and play Make it Train on devices you own or control, for your own non-commercial entertainment, subject to these terms and the rules of the store you downloaded it from (Apple’s Licensed Application End User License Agreement, or the Google Play Terms of Service).

2. What you may not do

• Copy, modify, decompile or reverse-engineer the app, except where the law allows it
• Sell, rent, lend or redistribute the app or its content
• Use cheats, exploits or automated tools to tamper with the game or its ads
• Use the app in any unlawful way

3. Stars and Shop items

Stars and the trains, track and stations in the Shop are in-game items with no real-world money value. They can’t be bought, sold, traded or exchanged for cash, and they’re stored on your device only, so they may be lost if you uninstall the app or reset your progress.

4. Remove Ads purchase

The optional Remove Ads purchase is sold and processed by Apple or Google. Prices are shown in the store before you buy. Refunds are handled by the store under its own policies; please contact Apple or Google to request one. You can restore Remove Ads on your other devices signed in to the same store account, using Restore purchases in the Shop.

5. Advertising

The free version shows ads provided by Google AdMob. We’re not responsible for the content of third-party ads or for any products or services they promote. See our Privacy Policy for how ads use data.

6. Ownership

The app, its artwork, characters, levels, sounds, code and the Make it Train name and logo belong to us or our licensors and are protected by copyright and trademark laws. These terms don’t give you any ownership rights.

7. Updates and availability

We may update, change or remove features, levels or Shop items, or stop offering the app, at any time. We aim to keep the game running smoothly, but we can’t promise it will always be available, error-free or compatible with every device.

8. Disclaimer

The app is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement, to the fullest extent permitted by law.

9. Limitation of liability

To the fullest extent permitted by law, we won’t be liable for any indirect, incidental, special or consequential damages, or for loss of data or game progress, arising from your use of the app. Our total liability for any claim is limited to the amount you paid us for the app in the twelve months before the claim (if you never bought Remove Ads, that is zero). Some places don’t allow these limits, so they may not all apply to you.

10. Apple-specific terms

If you downloaded the app from the App Store, you acknowledge that these terms are between you and Make it Train, not Apple. Apple has no obligation to provide maintenance or support for the app, is not responsible for any claims relating to it, and is a third-party beneficiary of these terms with the right to enforce them against you.

11. Governing law

These terms are governed by the laws of the United States. Nothing in them takes away rights you have under the consumer protection laws of the country where you live.

12. Changes to these terms

We may update these terms from time to time. We’ll post the new version here with a new “Last updated” date. Continuing to use the app after a change means you accept the updated terms.
